CATEGORIES AND SOURCES OF PERSONAL INFORMATION WE COLLECT

The personal information we collect depends on how you interact with us, the Products you use, and the choices you make. Harley-Davidson Retail and Harley-Davidson Motor Company (as applicable, depending on customer location) will also collect personal information from you in the context of online sales.

Information you provide to us. You provide information to us in various ways, depending on how you interact with us. For example, you provide personal information to us when you visit one of our websites, save your information with us online, contact us with a question or concern, or want to organize a test ride or organize a rental, submit your information for warranty purposes, or participate in a contest, promotion, or survey. The information we may collect from you includes the following:

  • Contact Information: Depending on the nature of your interaction with us, we collect personal or business information such as name, email address, postal address, and phone number.
  • Demographics: When you interact with us or our Products, you may also provide additional information such as your age range, nationality, and gender.
  • Profile data. We may collect information for your profile, including purchases or orders made by you, your interests, preferences, clothing sizes, warranty information for products you purchase, feedback and survey responses, and customer testimonials.
  • Commercial and Payment Data: If you make a purchase, we collect credit card numbers and other payment or billing information, and details on Products purchased.
  • Preferences: You may indicate preferences such as your preferred communication method, language, time zone, and dealer. When you use the vehicle shopping tools on our website, you indicate through your browsing and searches the kinds of vehicles, features, and options you may be interested in.
  • Audio/Visual: In some cases, you can upload a photo for a profile image when creating an account, or you may provide your photo at an event or as part of a contest or sweepstakes.
  • Identifiers: Depending on the nature of your interaction with us, you may provide us with unique identifiers associated with you. For example, when you leave a comment on one of our social media sites, you provide us with your social media ID.
  • Security Credentials: When you create or modify your Harley-Davidson account, you provide us with an email/username and password, along with other information used to authenticate your account.
  • Content of Communications: When you communicate with us, such as via emails, customer service requests, survey responses, website chats or social media posts, likes, or messages, we collect the content of your communication. This includes information collected or generated for customer service purposes, including chat history with customer service representatives and details of any phone calls or other requests addressed to our customer service team (nature and purpose of request, service and repair history and any follow-up actions). Specific to webchat, Harley-Davidson Motor Company utilizes Salesforce. Harley-Davidson Motor Company uses a Supplier, Inktel from a customer service aspect.
  • Vehicle Service History: We collect vehicle service history from you when you provide it to us.

When we ask you to provide personal information to us, you may decline (such as not entering a credit card to use wallet services). But if you choose not to provide information that is necessary for certain Products, those Products may not function correctly or be available for use.

Information we collect automatically from devices. When you use our websites, mobile apps, online services, and other Products, we and our service providers may automatically or passively collect certain information from the devices you use, including:

  • Device Details and Network Information. Some devices reveal, and our servers log, information such as type of device, hardware model, MAC Address, operating system, version, settings, configuration, and network-related information (for example, IP address, mobile network provider, etc.). We may also collect other device information if you enable that functionality in our mobile apps. As described more in the Cookies section below, our websites and online Products store and retrieve device identifiers (such as browser and other unique online identifiers) using cookies, pixel tags, and other digital technologies set on your device.
  • Digital Activity. As described more in the Cookies section below, when you browse our website or use our other online Products, we collect information about your online activity and interactions with our Products, such as access times, webpages or content viewed, the URL that referred you to our sites, mouse movements, scrolling, features used, how the webpage or online feature performed, and the results of vehicles viewed during previous visits.
  • Device and Mobile Location. Depending on your device and app settings, we may also collect location data from your devices. We may use GPS (global positioning systems) software, geo-filtering, and other location-aware technologies to locate you, sometimes precisely, for purposes such as verifying your location and delivering or restricting content based on your location. Our Products may be personalized to you based on various information we may have about you to provide you with more location-relevant content. If your mobile device is connected to your vehicle via Bluetooth or tether, vehicle location may be derived from mobile device location.

Information we generate about you. We generate information from the data we collect. For example:

  • Inferred Data. When you search for vehicles on our website, we generate results that fit your criteria and allow you to save results so they are available to you in future visits. When you browse our website or use our online Products, we may infer your zip code, city, state, and country based on your IP address.
  • Inferred Preferences. We infer new information from other data we collect, including using automated means to generate information about your likely preferences or other characteristics. For example, we may infer information form your online activity and interactions with our Products, such as webpages visited, vehicles viewed, and app features used.
  • Unique Identifiers. When you interact with us, we may generate unique identifiers associated with you or your devices such as browser or other online identifiers. These unique identifiers help us identify you or associate you with information about you.

Information from other sources. We obtain information from others when you direct them to disclose information to us and from the following sources:

  • Our corporate family and affiliates. We receive information from other companies within the Harley-Davidson family of companies and affiliates. Our “family of companies” is the group of companies related to us by common control or ownership. Information is disclosed within this “family” as a normal part of business operations and to offer and provide products and services to our customers.
  • Dealers and Other Repairers. We receive information in connection with vehicle sales and service. For example, when you purchase a vehicle from a Harley-Davidson dealer, the dealer provides Contact Information to us, including your name and address, as well as VIN and purchase information such as purchase date. We also receive vehicle service history information (and certain other vehicle repair information), which includes the history of repairs and may include information such as visit details, service details, repair history, applicable recall repairs, repair order details and payment, and warranty and extended service plan information. We may receive vehicle diagnostic information from dealers or other repairers when your vehicle is serviced or repaired using diagnostic scan tools connected to your vehicle.
  • Vendors and Suppliers. We may receive Contact Information or other personal information from our vendors or agents working on our behalf for the purposes described in this Notice.
  • Advertising and marketing partners. We receive personal information from other companies we work with to offer services to our customers or to reach potential customers with our marketing messages. Examples include:
    • Advertising and Analytics Companies. Please see the Cookies section of this Notice for a description of how we receive information from advertising and analytics providers.
    • Joint Marketing Partners. We may receive personal information from partners with which we offer co-branded services or engage in joint marketing activities.
  • Law enforcement agencies, courts, regulatory agencies, and others. We may receive personal information from government agencies or courts for legal compliance purposes, to protect your personal safety or the safety of others, to protect our or others’ rights or property, or to investigate fraud.
  • Consumer Data Analytics Firms. We receive Demographics and other data from third parties for purposes such as better understanding our customers, supporting our marketing campaigns, and personalizing Products to our customers.
  • Parties to Corporate Transactions. We may receive personal information as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of business or assets.
  • Publicly Available Sources. We may obtain Demographics and other data from publicly available sources, such as open government databases or other data in the public domain, as well as information that is publicly available online on social media, networking, and other sites.

We may combine personal information we collect from any of the above sources.

COOKIES AND SIMILAR TECHNOLOGIES

Tracking technologies that may be used on our websites include:

  • Cookies, which are bits of electronic information that a website may transfer to a visitor's computer to identify specific information about visits to a website.
  • Pixel tags (also called “action pixels”, “web beacons”, or “clear gifs”) and/or JavaScript plug-ins placed on websites or in emails sent to you. These are small graphic images (typically that you cannot see) or code on a website or in an email message which may be used for measuring click-throughs or tracking the performance of email marketing campaigns.
  • Web server logs, which create a record of activity on the website, such as if you enter a search term into a search box.

We may combine certain automatically collected information with other information we obtain about you, which may include data we obtain from third parties. We or other parties may collect personal information about your online activities over time and across different websites when you use our websites.

We may use certain third-party web analytics services. We’ve implemented Google Analytics Advertising features such as dynamic remarketing, interest-based advertising, audience targeting, behavioral reporting, demographics and interests reporting, user segment analysis, device reporting, display advertising, and video ads reporting. We and our vendors may use first-party cookies or other first-party identifiers as well as third-party cookies or other third-party identifiers to deliver advertisements, create a profile of you, measure your interests, detect your demographics, detect your location, detect your device, and personalize content.

For more information on how Google Analytics uses data collected through our websites, visit: www.google.com/policies/privacy/partners/. To opt out of Google Analytics cookies, visit: http://www.google.com/settings/ads and https://tools.google.com/dlpage/gaoptout/

You may opt out of Facebook Custom Audience by logging into your Facebook account and changing your privacy or advertising settings as per Facebook’s opt-out instructions. You may also use your Facebook account settings to unlink your Facebook account from our websites.

Interest-based advertising. As noted above, on some pages of our websites we allow third-party advertising partners to use cookies, web beacons, and other digital technologies to collect or receive information regarding your activities on those web pages (e.g., your IP address, page(s) visited, time of day, and other identifiers). We may also disclose such information we have collected to Advertising and Analytics Companies. These companies may use this information (and combine it with information collected over time and across other websites, apps, or other digital services) for purposes of delivering targeted advertisements to you, to provide measurement services when you use Harley-Davidson Motor Company products, and when you interact with other (non-Harley-Davidson Motor Company) websites and online services. This practice is commonly referred to as “interest-based advertising” or “online behavioral advertising”.

You can opt out of certain cookies and other technologies by clicking on the Cookie Settings link in the footer of our websites. You can also learn more by visiting our Your Privacy Choices Page and the additional information below.

  • Industry-wide opt-outs. Many advertising and analytics providers are members of associations, which provide a simple way to opt out of analytics and ad targeting, which you can access at Network Advertising Initiative and Digital Advertising Alliance.
  • Mobile advertising ID controls. Apple and Android mobile devices each generate an advertising identifier that can be accessed by apps and used by advertisers in much the same way that cookies are used on websites. Each operating system provides options to limit tracking and/or reset the advertising ID.
  • Browser controls. Web browsers vary on whether they are set to accept or allow various types of cookies and similar digital technologies by default. You can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies and similar digital technologies, this could affect certain features or services of our website. If you choose to delete digital technologies, settings and preferences controlled by those digital technologies, including advertising preferences, may be deleted and may need to be recreated.
  • Do Not Track. Some browsers have incorporated “Do Not Track” (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our websites do not currently respond to browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described above.
  • Email web beacons. You can disable web beacons in email messages by changing the settings on your email client to prevent the automatic downloading of images.

We may collect, use, store and transfer different kinds of personal information about you which we have grouped together as follows.

RETENTION OF PERSONAL INFORMATION

The amount of time Harley-Davidson will retain personal information varies, depending on the services Harley-Davidson has provided and the nature of the personal information that Harley-Davidson holds. Harley-Davidson only retains personal information for such period of time as is necessary for the legitimate purposes for which the personal information is processed.

Where you purchase products from us online, we may also retain information about your order history (such as Transaction Data relating to previous orders) for up to 10 years.

Legal requirements, however, may require us to retain some or all of the personal information we hold for a period of time that is longer than that for which we might otherwise hold.

When personal information is no longer required by Harley-Davidson or by law, Harley-Davidson will either convert it into an aggregated non-identifying form or Harley-Davidson will appropriately destroy or erase the personal information.

We endeavor to ensure that any personal information in our possession is as accurate, current, and complete as necessary for the purposes for which we use and/or disclose such personal information. If we become aware that your personal information in our possession is inaccurate, out-of-date, or incomplete, we will endeavor to revise such personal information accordingly.

CHOICE AND CONTROL OF PERSONAL INFORMATION

We are committed to providing you with meaningful choices regarding the use and disclosure of your personal information.

Access, correct, or delete your information. If you are a registered user, you may review, update, and change the information you provided to us at any time by accessing your account settings. Users may also use our webform to request copies of your data or request that we correct or delete your data, subject to applicable exceptions. We will endeavor to complete your request within a reasonable period, generally no later than 30 days following the request, unless we notify you of the need to extend this period. Where we refuse to correct, provide access to, or delete personal information requested by you, we will inform you of the reasons for our refusal.

To guard against fraudulent requests for access, correction, or deletion we may require additional information to allow us to confirm that the individual making the request is authorized to do so before granting access, making corrections to, or deletion such personal information.

We will not generally charge you for accessing, correcting, or deletion your personal information; however, to the extent permitted by applicable law, we may charge you for a fee if you request a copy of any records containing your personal information, or if your request is excessive or manifestly unfounded. To request access to, correction, or deletion of your personal information, please use our privacy request form or contact our Chief Privacy Officer at [email protected].

You may opt out of the disclosure and use of personal information we collect through certain cookies or other online advertising technologies (collectively, “Cookies”), including opting out of selling your personal information for monetary and non-monetary value (“sell”), sharing your personal information for cross-context behavioral advertising (“share”), and targeted advertising by setting your Cookie preferences, which you can access by clicking on the “Manage Cookie Preferences” link at the bottom of this website. Note that this opt out will apply only to the device or browser you are using when submitting the request. You may also opt out of these disclosures by using the Global Privacy Control, which is designed to recognize opt-out preference signals. To send your request through an opt-out preference signal, you must use a browser or extension supporting the preference signal and must turn it on for each browser and each device you use. See the Cookies and Similar Technologies section, above, for more information about your choices related to cookies and other analytics and advertising controls.

Opting Out for Activities Other Than Cookies. You may request that Harley-Davidson not sell, share, or target ads using your personal information through activities other than Cookies by submitting a request through this form.

Electronic communications preferences. If you do not wish to receive marketing communications from us, you can opt out of future marketing communications by following the instructions provided in those communications, for instance, in the footer of an email communication. Opt outs are entity specific. Opting out with respect to one entity is not automatically effective with respect to the others. For example, opting out for Harley-Davidson Motor Company does not opt you out of communications from Harley-Davidson Financial Services. If you receive text (SMS) messages from us, you can stop delivery of further messages of that type by following the instructions provided or replying “STOP”, after which you will receive a single message confirming your choice. Opting out of marketing communications will not affect our administrative communications to you (e.g., communications about your transactions or policy changes). We may also need to contact you via telephone, email (in accordance with applicable laws), postal mail, or notification via the mobile app with questions or information regarding your order or subscription. Further, we are required by law to provide motorcycle owners with warranty and recall information.

Children’s Privacy: Our online services are not intended for children under the age of 16 and we do not knowingly collect information online from children under the age of 16. If we become aware that we have obtained information from a child under the age of 16 we will delete such information in accordance with applicable law.
